  1. Awesome Holiday Rentals is a trading name of Bakasyon LTD (collectively referred to as “Awesome Holiday Rentals”, “AHR”, “we”, “us” or “our” in this privacy policy). 
  2. This privacy policy outlines how Awesome Holiday Rentals may collect, utilize, disclose, or otherwise handle personal data of our customers in compliance with the Personal Data (Privacy) Ordinance (PDPO) in Hong Kong. This Policy pertains to personal data within our possession or control, including personal data held by third-party organizations engaged by us for the collection, use, disclosure, or processing of personal data for our purposes. 
  3. We process personal data based on your consent in accordance with the relevant provisions of the PDPO, which you are free to provide or withhold. You have the freedom to withdraw your consent for us to retain this information at any time. Your decision to revoke consent will not affect the lawfulness of processing based on consent prior to its withdrawal. 

Personal Data 

  1. We gather information provided by you when registering on our website, placing an order, subscribing to our newsletter, participating in a survey, or completing a form. You may be prompted to furnish details such as your name, email address, mailing address, phone number, country of residence, passport issuing country, or credit card information. 
  2.  Typically, we refrain from collecting your personal data unless: (a) it is voluntarily provided by you directly or through an authorized third party, following notification of the purposes for data collection, and obtaining your written consent for such collection and usage; or (b) collection and usage without consent is permitted or required by the PDPO or other applicable laws. Any additional personal data collection or usage for purposes not previously notified to you will be subject to your consent, unless permitted or authorized by law. 
  3. We retain your personal data only for the duration necessary for our business operations and limit its utilization to essential services or as mandated by law. We kindly request that you refrain from disclosing any Sensitive Personal Data (e.g., race, religion, ethnicity, medical or health information, sexual orientation, etc.) unless specifically requested. 

Data Gathering 

  1.  The information collected from you may be utilized for the following purposes: 
  • Fulfilling obligations related to the provision of goods and/or services requested by you. 
  • Verifying your identity. 
  •  Addressing and processing queries, requests, applications, complaints, and feedback from you. 
  • Managing your interaction with us. 
  • Sending marketing communications regarding our goods or services, including notifications of marketing events, initiatives, promotions, membership and rewards schemes, and other promotions. 
  • Ensuring compliance with applicable laws, regulations, codes of practice, guidelines, or rules, and assisting in law enforcement and investigations conducted by governmental and/or regulatory authorities.

  • Where such disclosure is necessary for fulfilling obligations during or in connection with the provision of the goods or services requested by you.

The purposes outlined in the above clauses may continue to apply even after the termination or alteration of your relationship with us (e.g., pursuant to a contract), for a reasonable period thereafter, including, where applicable, a period to enable us to enforce our rights under any contract with you. 

Data Protection 

  1. We employ a secure server and regularly enhance administrative, technical, and physical security measures to safeguard your information from unauthorized access, loss, alteration, or destruction. 
  2. Sensitive credit information is transmitted using Secure Socket Layer (SSL) technology and subsequently encrypted into our Payment gateway providers’ database. Access to this data is restricted to authorized personnel with special access rights, who are obligated to maintain confidentiality. Following a transaction, sensitive credit information (such as credit card details and financial data) is not retained on our servers. 

Third Parties 

We disclose your personal information under the following circumstances and to the following parties: 

  1. To third parties, only if you are staying in one of our accommodations and request additional services, such as airport transfers or private chefs. 
  2. To enable third-party vendors, consultants, and service providers to perform services on our behalf. 
  3. To comply with laws or respond to claims, legal processes (including subpoenas and court orders), and requests from public and government authorities. 
  4. To cooperate with regulatory bodies and government authorities. 
  5. To third parties to pursue available remedies or limit damages that we may incur. 
  6. To a third party in the event of any reorganization, merger, acquisition, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business or assets (including in connection with bankruptcy or similar proceedings). 
  7. To include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. Therefore, we are not responsible or liable for the content and activities of these linked sites. Nonetheless, we strive to maintain the integrity of our site and welcome any feedback regarding these sites. 

Your Legal Rights 

Request access to your personal data. This allows you to obtain a copy of the personal data we hold about you and verify that we are processing it lawfully. 

  1. Request correction of your personal data. You have the right to have any incomplete or inaccurate data we hold about you corrected, although we may need to verify the accuracy of the new data you provide. 
  2. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no valid reason for us to continue processing it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully, or where we are required to erase your personal data to comply with local law. However, please note that we may not always be able to comply with your request for erasure due to specific legal reasons, which will be communicated to you if applicable at the time of your request. 
  3. Object to the processing of your personal data where we are relying on legitimate interests (or those of a third party) and there is something about your particular situation that makes you want to object to processing on this ground, as you believe it impacts your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information that override your rights and freedoms. 
  4. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to verify the accuracy of the data; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise, or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it. 
  5. Request the transfer of your personal data to you or to a third party. We will provide your personal data to you or a third party you have chosen in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information that you initially provided consent for us to use or where we used the information to perform a contract with you. 
  6. Withdraw consent. If we are relying on consent to process your personal data and you wish to withdraw your consent, this will not affect the lawfulness of any processing carried out before you withdraw your consent. However, if you withdraw your consent, we may not be able to provide certain products or services to you. We will inform you if this is the case at the time you withdraw your consent.

You can request to stop receiving marketing messages from us at any time by using the opt-out unsubscribe links provided in any marketing message sent to you or by contacting us at email. Please note that opting out of receiving marketing messages will not affect the personal data you have provided to us as a result of purchases or other transactions.
